So that you can browse our site with complete peace of mind, we at SIEL-Territoire d’énergie Loire, as a data controller, set out here how we collect, process and use your personal data to provide you with new services day to day, in line with your rights.

We protect your privacy by guaranteeing the protection, confidentiality, non-alteration, availability and security of the personal data you entrust to us on all our communication channels.

We take all the necessary measures to:

To achieve these objectives, we take appropriate technical and organisational measures to ensure that the processing we carry out is compliant with the applicable law on personal data protection.

1.2  WHAT TYPE OF PERSONAL INFORMATION DO WE COLLECT ?

We collect the information that you provide to use when we are exercising our public service mission.

– when we are managing your works file

– when you exchange with our users department (THD42) 

The items of information that it is strictly necessary to collect to provide you with a service, are marked with an asterisk and generally include your surname, first name, e-mail address, landline or mobile telephone number, technical details relating to your project (land registry markets, user references for public utilities managed by SIEL-Territoire d’énergie Loire).

In accordance with the law, we do not collect data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, personal genetic data, biometric data for the purpose of uniquely identifying a natural person, personal data concerning health or personal data concerning a natural person’s sex life or sexual orientation. 

These specific categories of personal data are never collected or processed by a third party unless specifically mentioned in the case of a public service delegation arrangement.

 

2.  HOW DO WE USE YOUR DATA ?

 

 

We process your personal information in a transparent and secure way. Your personal information is collected for the purposes detailed below.

 

2.1   MANAGEMENT OF OUR OBLIGATIONS TO OUR CUSTOMERS

Communication with you  

We collect and retain your personal data so that we can communicate with you about your enquiries, bills or complaints.

Legal and regulatory requirements

We may be obliged to pass on your personal data in the event of legitimate requests from public authorities, in particular in response to requirements relating to national security, the fight against fraud or the application of the law.

Other cases

In all other cases, you will be informed of any processing that SIEL-Territoire d’énergie Loire intends to carry out. 

 

2.2  WHO ARE THE RECIPIENTS OF YOUR PERSONAL DATA ?

We ensure that only authorised members of  SIEL-Territoire d’énergie Loire’s staff can access your personal data when such access is necessary to the fulfilment of our public service mission.

Our service providers may also be recipients of personal data strictly necessary to the performance of the services we have entrusted to them.

 

2.3 WHERE ARE YOUR PERSONAL DATA STORED ?

 

The data are stored in line with French legislation and European regulations.

We may need to share with other companies the personal data necessary to the implementation of the services that you contracted or signed up to (e.g. connection to the electricity or fibre optic networks, charging stations, urban heating, etc.). Operations with service providers that are recipients of your data are the subject of a contract in order to guarantee you the protection of your data and respect for your rights.

If our provider operates outside the European Union, we protect the confidentiality of your personal information and your rights by using the data protection clauses recommended by the European Commission.

Respecting your right to the protection, security and confidentiality of your data is our priority. 

SIEL-Territoire d’énergie Loire takes technical and organisational security measures appropriate to the degree of sensitivity of personal data to protect them against malicious intrusion, loss, alteration or disclosure to unauthorised third parties. 

When designing, developing, selecting or using services that depend on the processing of personal data, SIEL-Territoire d’énergie Loire takes account of data protection rights from the outset. 

As all personal data are confidential, access to them is limited to SIEL-Territoire d’énergie Loire’s employees or service providers acting on behalf of SIEL-Territoire d’énergie Loire on a need-to-know basis. All persons with access to your data are bound by a duty of confidentiality and would be subject to disciplinary measures and/or other sanctions if they failed to comply with these obligations. 

Operations with third parties are the subject to a contract in order to guarantee you the protection of your data and respect for your rights. 

We are totally committed to effectively protecting the personal data that you entrust to us. In the interests of security and to protect your data, which is a constant concern for us, we encourage you to be exercise great care to prevent any unauthorised access to your personal data and to protect your devices (computer, smartphone, tablet) against any unwanted, or criminal access by using a robust password, which you should change regularly. 5. GlossaRY

 

Collect” refers to the collection of personal data. This may be carried out using online questionnaires or forms ;

Consent” : your consent means any freely given, informed and unambiguous indication of you the data subject’s wishes by which you, by a statement or clear affirmative action, signify agreement to the processing of personal data relating to you ;

Personal data” refers to any information relating to an identified or identifiable person; who is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person ;

 “Rights to the protection of your personal data” : refers to all the fundamental rights as described in the European Regulations [2], i.e.

– right to information.

– right of access.

– right to rectification.

– right to erasure or right to be forgotten.

– right to data portability.

– right to object.

– right to restrict processing.

– right to give instructions concerning the retention, erasure and disclosure of your personal data after your death.

Restriction of processing” means the marking of stored personal data with the aim of limiting their processing in the future [3] ;

Data minimisation” refers to a limitation on the collection or use of information ;

Data pooling” means the result of the pooling of the customer or prospect clients databases of several partners ;

Profiling” means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements” ;

Products or services” means all the products and services, including technological ones (websites, applications and related services) offered now or in the future by SIEL-Territoire d’énergie Loire ;

Data controller” : is the person or organisation that determines, alone or jointly, the aims and methods of processing your personal data ;

Behavioural segmentation” enables a socio-economic or even a psychological profile of a person to be established, based on information on their behavioural patterns, so that they can be classified in a segment ;

Online services” refers to the digital services offered by SIEL-Territoire d’énergie Loire such as the website, applications, related services or mobile services ;

Processor” : is the person that processes the personal data on behalf of the person, structure or organisation responsible for the processing ;

Behaviour monitoring“, sometimes known as “profiling”, refers to techniques that are used to evaluate behavioural aspects of a physical person in relation to their internet use.

Third party” refers to anyone other SIEL-Territoire d’énergie Loire and yourself ;

 “Personal data processing” means any operation or group of operations applied to your data, whatever the medium of the online in question and the process used.
